Jurisdiction and Severability
The jurisdiction of these Terms of Service and any disagreement arising hereunder shall be Lawrence County of the State of Missouri, United States of America. If any portion or any terms of these Terms of Service are declared invalid or unenforceable, the remaining portions or terms shall be considered to remain in full force or effect.
Hand-Made Products, Natural Materials
We sell hand-made products from natural materials. Each product is unique, special, and will naturally vary to some extent from every other product in color, consistency, exact dimensions and weight, thickness, and other details. Products may have minor blemishes, evidence of the tools or natural condition or variation of the materials that went into them, extra finishing touches, or other features that distinguish them from mass-produced, machined products. These are works of art and we would have it no other way.

We are very reluctant to ship items to addresses other than the verified PayPal/Google Checkout
address or the address on your personal checks, especially for orders of any significant amount. For Gold Customers where we have enough of a business history to help us detect fraud, we can arrange to ship to an alternate address or gift address, but we will need to contact you by a previously used method (e.g. phone) to make sure that this is authorized. Unfortunately, fraud is too common and we do not want to facilitate you being robbed by someone who has gotten hold of your information and logged onto our website, nor do we wish to deal with returned checks or charge-backs. We will ship items
payed by Money Order to anywhere you wish.
You can cancel this order within one week after we have received it (If it has not been shipped. A different policy applies to deposits on custom orders.) You can return new, unused, undamaged items from a canceled order within one week after they have been delivered to you. Items should be returned in their original packaging. You pay return shipping. At our option in the case of error on our part, we may elect to refund your shipping cost or otherwise provide some additional compensation for your trouble.
If you receive items which have been damaged in shipping, please contact us and your carrier (e.g. USPS/UPS/FedEx)
immediately. We provide insurance when shipping our items. The carrier will need to inspect the original packaging and the condition of the item as soon as possible after you have received it. Once we hear from the carrier, how they will handle the insurance payment, and what will become of the damaged item, we will work with you to resolve your order: replacement, refund, cancellation, credit, or other appropriate action.
For custom orders, you will generally be paying for an up front deposit rather than the entire cost of the item. The remainder of the cost will be due when your item is completed and ready to ship. Whether you pay a deposit or in full, some or all of your payment may be spent purchasing special materials or your custom item may be something that we may not readily resell, so you may or may not be able to have your deposit refunded (or not immediately) if you cancel your order once work has begun.
Out of Stock Items
Our website tracks the availability of items we stock. Therefore, any non-custom items you checkout through the online system should be available to ship as noted on the website. In some rare cases, we may not have an item available to ship. This may be because an item has been damaged or marred in storage and is therefore not suitable to send you without allowing you to cancel, offering you substitution, or discounting your order. We will notify you as soon as we are aware of a problem.
In some cases, we may be present at a local event, a farmer's market or festival, when you buy the same item online which someone has purchased locally. We usually have enough stock that this does not happen often, but at larger events, like Apple Butter Making Days, or for unique items, the possibility is much higher. If this happens, we will notify you as soon as possible and give you options for refund, substitution, or delaying your purchase while we produce a new item to order.
You may pay by money order (or by personal check for Gold Customers). The payment must be received and cleared before an item will be shipped (or work started in the case of a custom order). We will hold checks up to 10 business days to ensure that they clear. Money orders will clear much faster and are preferred. Returned checks will normally be assessed a $30.00 fee, although we may, at our sole and absolute discretion, allow you to make
things right with a money order as long as any bank charges on our end are taken care of. Honest mistakes happen and we want your business, but you are responsible for avoiding problems and making them right afterward.
Evidence of check fraud will be reported to the authorities.
If you have a dispute with us over an item or service, your first step is to contact us. We are a small, family business and will attend to the matter personally. We want you to be happy with your purchase and we want your continued business. Please read through these terms of service, your item description, and any emails we have exchanged so that we can both understand what was agreed to and where we are having problems. In all cases, we are not liable for any amount in excess of the cost of your purchase. We may, at our sole and absolute discretion, elect to compensate you further, through store credit or other means for any inconvenience you may suffer through any error or accident.
If this is not sufficient, and you paid through PayPal or Google Checkout, you may use the PayPal or Google Checkout dispute resolution process to open a claim against us and dispute your purchase. This process will allow PayPal/Google to arbitrate the dispute and attempt to resolve our difficulties. If you paid via a Credit Card through PayPal, you may attempt to void your transaction through your credit card company, but you should be aware that this may hurt your standing with PayPal and that we will consider the action to be very impolite, especially if you have not tried to resolve the issue in any other fashion.
Lack of Implied Warranty
We warrant that you will receive an item substantially similar to that which is described in the product listing, subject to our note above regarding hand-made products and natural materials. We make the best possible effort to ensure quality and will attempt to work with you if you have any problems with any purchase. Beyond that, we do not offer any other implicit warranty, including a warranty of merchantability or suitability for a specific purpose, including use to ward off evil spirits, cure cancer, stop bullets, or make you taller. Please refrain from setting yourself, others, or your possessions on fire with our candles, attempting to eat our soap, or using our yarn to rappel down cliff faces; such uses shall make you unhappy and endanger your ability to continue purchasing from us. In all cases, we will not be liable for more than the cost of your purchase unless in our sole and absolute discretion we choose to provide you with further compensation, such as store credit, for any inconvenience.
